• North American over-the-road (OTR) trucking

• Ocean container shipping (FCL/LCL)
• Customs clearance and documentation
• Carrier updates shared as they come in
• Freight coordination and dispatch

3. User Responsibilities

As a user of our services, you agree to:

• Provide accurate and complete information about your shipments
• Comply with all applicable laws and regulations
• Not use our services for illegal or prohibited purposes
• Not misrepresent the contents or nature of your cargo
• Pay all fees and charges associated with our services

4. Cargo Liability and Insurance

Flash Cargo Network acts as a freight forwarder and logistics coordinator. Liability for cargo is subject to:

• Applicable international shipping regulations and conventions
• Carrier liability limitations as per bills of lading and air waybills
• Insurance coverage as specified in your service agreement
• Proper declaration of cargo value and contents

We recommend obtaining comprehensive cargo insurance for all shipments. Claims must be filed within the timeframes specified by applicable regulations and carrier agreements.

5. Pricing and Payment Terms

All pricing is subject to:

• Accurate cargo information and weight declarations
• Applicable fuel surcharges and market rates
• Customs duties and taxes as applicable
• Additional fees for special handling or services

Payment terms are as specified in your service agreement or invoice. Late payments may result in service suspension or additional charges.

6. Delivery Timeline and Delays

While we strive to meet delivery timelines, we cannot guarantee specific delivery dates due to factors beyond our control, including:

• Weather conditions and natural disasters
• Customs delays and regulatory inspections
• Carrier delays and scheduling changes
• Port congestion and capacity constraints
• Incomplete or inaccurate documentation

We will communicate any delays promptly and work to minimize impact on your shipment.

7. Prohibited Items

We cannot transport the following items:

• Hazardous materials without proper certification
• Illegal or counterfeit goods
• Weapons, explosives, or ammunition
• Controlled substances
• Items prohibited by destination country laws
• Perishable goods without proper handling

Misrepresentation of cargo contents may result in legal action and service termination.

8. Limitation of Liability

To the maximum extent permitted by law, Flash Cargo Network shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website, including but not limited to loss of profits, data, or business interruption.

You agree to indemnify and hold harmless Flash Cargo Network, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these terms, or violation of any applicable laws.

These Terms of Service are governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts located in Toronto, Ontario.

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of the modified terms.
